Terms of Use

These terms apply to everyone who uses vacationrentalspoconos.com, the website of Poconos Vacation Rentals LLC (“we” or “us”). By using the site, you agree to them.

1. We are a listing service, not a party to rentals

We advertise vacation homes listed by independent owners and property managers (“hosts”) and pass booking requests from travelers (“guests”) to those hosts. We do not own, manage, operate, inspect or control any home. We are not a real estate broker, property manager, travel agent or party to any rental agreement. Any rental is a contract solely between the guest and the host.

2. Booking requests

Sending a request does not create a reservation or any obligation. If a host accepts, the host will contact you to agree on the price, taxes, deposit, house rules, cancellation terms and payment. A stay is booked only when you and the host finalize it directly. Prices, availability and descriptions on the site come from hosts and may change; the host's confirmation controls.

3. We don't handle payments, stays or disputes

We never collect rent, deposits or booking fees from guests. Guests pay hosts directly under the host's terms. Questions, changes, cancellations, refunds, damage, access, cleanliness and any issue during a stay must be handled between the guest and the host. We are not responsible for them.

Some hosts ask for a refundable security deposit, or let guests buy damage protection from an independent company instead. A deposit is paid to and refunded by the host under the host's rental agreement. Damage protection is bought directly from that company under its own terms, and any claim is between you, the host and that company. We show these options as the host describes them. We don't sell, recommend or provide insurance, and we receive no payment for these products.

4. Host responsibilities

Hosts are responsible for: the accuracy of their listings; holding all permits and licenses their township requires; following HOA and local rules; collecting and paying applicable taxes; their own rental agreements, insurance and guest communications; and complying with fair housing and consumer protection laws. Listing plans, renewals, cancellations and refunds are covered by our Owner Listing Terms, which hosts agree to when they list a home.

5. Verified Hosts

Our Verified Host badge means we completed the checks described on our Verified Hosts page. It is not a guarantee of a home's condition, safety or a host's performance.

6. Text messages and emails

If you send a booking request, you agree to receive text messages and emails about that request from Poconos Vacation Rentals LLC and from the host, at the mobile number and email you provide. Message frequency varies. Message and data rates may apply. Reply STOP to stop texts or HELP for help. Consent is not a condition of any purchase. We do not send marketing text messages. If you choose to receive them, we may also send you occasional marketing emails, and you can unsubscribe at any time using the link in any email. Hosts receive booking-request texts only after agreeing to them.

7. Acceptable use

Don't misuse the site: no false requests or listings, scraping, spam, harassment, or attempts to collect other users' information. We may remove listings or block users at our discretion.

8. Disclaimers and limitation of liability

The site is provided “as is.” To the fullest extent the law allows, we disclaim all warranties and are not liable for any loss, injury, damage or dispute arising from any rental, home, host, guest, or a guest's or host's acts or omissions. Our total liability for any claim relating to the site will not exceed the greater of $100 or the amount you paid us in the past twelve months. Hosts and guests agree to indemnify us against claims arising from their rentals, listings or conduct.

9. Governing law

These terms are governed by Pennsylvania law. Disputes will be resolved in the state or federal courts serving Monroe County, Pennsylvania.
